State palms off jetty dispute

A JETTY dispute between Kevin Driscoll and the Noosa Council is no closer to being resolved and the Department of Environment and Heritage Protection (EHP) has washed its hands of the matter.
The dispute is over a publicly owned jetty at the corner of Williams Street and Gympie Terrace, which was purchased by Mr Driscoll and his wife in 1993.
Mr Driscoll says he has an independent engineer’s report which confirms the jetty was impacted by the shifting of a council owned footpath and was subsequently washed away during the cyclone Oswald floods in January 2013.
Mr Driscoll handed the independent engineer’s report in to council last week.
The matter was handed to the Department of Environment and Heritage Protection when Mr Driscoll made a one-man protest on top of the site.
But after removing the temporary structure, the department has now washed its hands of the matter referring all inquiries back to Noosa Council.
In a statement to Noosa Today a spokesperson for EHP said the matter has been finalised from EHP’s perspective.
“Matters regarding the footpath should be addressed to Noosa Shire Council,” the statement read.
Meanwhile, Noosa Council is preparing an application to repair the footpath adjacent to the jetty site, but will so far avoid repairs to the pylons.
“This is blatant injustice of my rights to property,” Mr Driscoll said.
“Noosa Council needs to stand up and admit the footpath impacted the jetty and pay for the damage caused.”
The matter was ongoing.
